These draft terms describe the general conditions for using Tenure’s website and services. A signed service agreement may include additional or different terms for a condominium board.
1. Acceptance of terms
By using this website or Tenure’s services, you agree to these terms and any applicable written service agreement. If you do not agree, please do not use the services.
2. Description of services
Tenure provides condominium building management tools and services, which may include maintenance coordination, vendor management, reporting, document access, communications, and related administrative support.
The exact scope, fees, service levels, and term for a client are set out in the applicable written agreement.
3. Account responsibilities
Users must provide accurate information, keep account credentials confidential, and promptly notify Tenure of suspected unauthorized access. Boards are responsible for identifying authorized representatives.
4. Acceptable use
You may not use the services unlawfully, interfere with their operation, attempt unauthorized access, upload harmful code, misuse another person’s information, or submit false or abusive requests.
5. Intellectual property
Tenure and its licensors retain ownership of the website, platform, branding, software, and related materials. Clients retain ownership of their building records and documents, subject to the rights needed for Tenure to provide the services.
6. Disclaimers
Tenure aims to provide reliable services but does not guarantee uninterrupted availability or that every third-party contractor will perform without delay or error. Specific obligations are governed by the applicable written agreement.
7. Limitation of liability
To the extent permitted by law, Tenure is not liable for indirect, incidental, special, or consequential damages arising from use of the services. Any additional limitations or remedies are set out in the applicable written agreement.
8. Governing law
These terms are governed by the laws of Quebec and the federal laws of Canada applicable in Quebec. Any dispute will be brought before the courts with jurisdiction in Quebec, unless a written agreement provides otherwise.
